Q.

iI40 with new Employer

I am in 7th year of H1b extension, i140 approved (EB3 - Priority date of Dec 2008) with Employer A. I joined the Client six months back and got a 3 year extension for both the H1s (with Employer A and Client).. Now the client is willing to file for EB2 processing. My question is can I use the same priority date as of my previous EB3 even if Employer A withdraws the approved i140 or is it true that the Employer A cannot withdraw the i140 after 180 days?
