Q.

I-140 Appeal to AAO

My I-140(EB3 skilled worker-substituted labor) was denied (due to 4 yrs bachelor) & we filed I290B.
1. April 16, 2009-Appeal was filed to USCIS
2. July 23, 2009-USCIS sent the 140 case to AAO
3. April 12, 2011-AAO returned the case to USCIS (per my attorney AAO didn't get the appeal brief, sent while filing I290B)
4. Date? : Attorney replied to USCIS and resent the appeal brief
5. May 24, 2011: USCIS resent the case to AAO

Since May 24, 2011, there is no update and I am afraid that if AAO consider this as a new case then the current processing time is 35 months (i.e. another 2-3 yrs). Will my case be treated as NEW/OLD & in this case what would be the processing time? How can we reach to AAO to open a service req/or discuss the matter? Any other way to expedite the process?
