Q.

Changing to fully owned subsidiary with different FEIN

I have been working for companyA for 5 yrs. I plan to switch to a fully owned subsidiary of the same companyA. This subsidiary has a different Employer Identifcation Number (FEIN/EIN). Can all the experience I gained with companyA (no. of yrs as well as special skill sets) be counted as previous work experience when I switch to the new entity in order to file for EB2 based LC? My employer intends to publish the new job requirements as Masters + 3 years OR Bachelors + 5 yrs of experience. Basically I want to know if I can use no. of yrs I worked for companyA to fulfill this requirement. Are there chances of LC audits because of this reason?Is changing to a completely different employer any different than this option as far as counting experience I gained with companyA is concerned?
