Q.

EB3 to EB2 Porting

I Got my I-140 approval in EB3 category from company A the priority date is Aug 2007.I left the company in June 2009 and came back to the same company(A)in May 2011.I have applied for EB2 position from the same company(A)in Jan 2011 with labor approved in Jan 2011 and I-140 approved in Jul 2011.But the date did not get ported.On the EB2 I-140 approval form it is showing the new date Jan 2011 but not the old date Aug 2007.It has the same Alien Number on both these I-140 approvals.I asked the attorney and they are saying that they are following up with USCIS on this.Is this the process that needs to be followed or is there any other process? If the date becomes current can I apply for I-485 with these two I-140s and ask for porting at the same time?Which way it works and what is the process.
