Q.

Travel on AP after Laid off and invoking AC21 with small company

I-140,EAD,AP approved,I485 pending over 180 days.
PD:Oct 24,2003 and I-485 filling date:July 2, 2007.
Laid off on H1B(expiring 4/19/09)effetive from Dec 31, 2008.
Concerns:
I like to visit INIDA in the month of March on current AP(expires on Aug 09)and like to return in 2 months.Is there any problem at the POE since I was laid off and no job currently? What should I answer If officer might ask “which company you are working for? How long you are working with that company? why did you take 2 months long trip?

I like to invoke AC21 with small consulting company. But the problem is he will not run my payroll until I get a job from one of his clients. Is this safe to join this company to invoke AC21. If that is the case, how can I invoke AC21 without having first 2 pay stubs initially?
