Q.

Primary 485 Approved before Derivative filed

Hi,

My 485(EB2) was filed in July 2007 and had a priority date of Dec 19 2006. I got married in 2009. I could not file my wife's 485 as I was not current. She has been on H4 till now. My date became current on July 1st 2011. And we sent my wife's 485 application on July 7th 2011. However, I learned today that my 485 was approved on July 5th. So far the checks sent with my wife's application have not been cased and I do not have a receipt number. Can you please advice the probability of her application getting rejected and what steps I should take to ensure that I remediate this situation. My understanding is that as soon as my 485 is approved her H4 is not valid any longer and she will be out of status. Would appreciate your advice.
