Q.

EB3 to EB2 Porting with same employer

8/18/2008- Joined company A as Sr.NET developer with 4 years of exp after 4 years BS
12/4/2009- EB3 PERM filed
5/25/2010- PERM approved
10/1/2010- I140 filed
2/16/2011- Company B acquired company A. title changed to Sr. Applications developer
6/16/2011- I140 approved with A as petitioner.

Now that I have about 7 years exp and company name and tax ID is different, can i get EB2 with the same employer. This is a fulltime position with fixed pay and I am not interested in moving to different employer.
Please advice.
