What are my options? (PERM filed, and now I want to telecommute)
I am currently in US on a H-1B visa. My employer filed my PERM application after a successful job market test. Recently, as my spouse got a job offer in another city, I went to request my manager for a telecommute from that new location. But my manager discussed with HR and Legal staff, and stated to me that this green card application is not valid if I do a telecommute from another city - as the job advertisement for market test did not indicate a telecommute.
1) Is it true or just a coercion tactic to not let me telecommute?
2) What are my options now as I want to do a telecommute?
3) Is it okay to amend the PERM application to include telecommute?
4) Does it require the employer to do another job market test after including telecommute in it and then file a new PERM application?
