Q.

I-485: Out of status while on L1

I'm currently on a H1-B with an approved I-140 and a PD of 08/01/2008.
I came to the US in 2002 on a L1. In 2005, my L1 extension was denied and I had to leave the US. I was informed of the denial after a week or so by company that I work for. After that, it took me around a month to leave the country, having had to sell my stuff, ship my remaining stuff back home, get the tickets to fly back etc. So technically I was "out-of-status" for about 40 days. I then came back to the US in 2006 on a H1-B.
Now will those "out-of-status" days come back to hurt me when I file my I-485? If it does, is there anything I can do to justify why it took me around 40 days to leave the country? I personally feel that I did whatever I could to leave at the earliest, but will the USCIS see it that way?
