Q.

EB3 I-485 pending, considering sec 245(a), 245(k) or 245(i)?

1)H1b 2003 to 2006. I-140 approved 3/15/2006. I-485 filed Jul 2007,EB3,ROW(Taiwan).PD- 6/30/2005, current since 3/1/2011. No unauthorized employment.
2)Issue: Entered US in 2007 without visa (was on EAD, but no valid I-512) The US customs granted my entry with (Visa) Waiver, penalty was paid, received a passport stamp showing:Admitted on H1B. Recently I saw my Adjudication Officer who insisted this incident "Entry without valid visa" impedes my I-485. No final decision is made, but I want to know: a)If I-485 disapproved, given above, would 245(a)or245(k) be a good altrntive? b)Being over 21, have 2 US citizen brothers, if they petition for me, being already current for i485, would it eliminate the wait time if eligible for 245(i)?
