Q.

Reinstate GC processing

I had applied for employment based GC (filed my I-485), my I-140 was also approved and priority date is Sept 2005 in EB3 category. I was in US from Jan 2005 to November 2009 and had valid EAD and AP. In December 2009 I decided to relocate to India. But before returning to India, I filed I-824 to transfer my case to CP(I received a notice from USCIS at my India address that means my case is processed). Now, I have returned back to US on H1B with a new employer. I have following questions to reinstate my GC processing.
* How to get EAD & AP based on old petition, so that I can work independently for any employer?
* Can my new employer file my Labor/I-14 on EB2 category and use old priority date based on EB3 category? With this arrangement I will be able to file I-485 along with I-140.
