Recapture priority date on my old LC under 245i
My Status: NEW PERM/I-140 approved;
Issue Background: On 05/1999,Company A filed a LC (Certified on 08/2000 with no I-140. This period appears to be covered by 245i rule, although I have not had any illegal stay in USA.
My question:
Can I recapture the PD of my old LC( filed on 05/1999) by filling I-485 immediately using 245i rule and the new I-140 ( I can provide prove that I was in USA on Dec 21, 2000)?
