Q.

Interfiling

Dear Attorney Liladhar-Hathi:

Yesterday I had my I-140 approved under EB1-1 category (self petitioned). My wife's employer has filed EB-3 in March 2004. In July 2007 she applied for i-140 (approved in a few months) along with concommittent I-485 (herself as primary and me as derivative). I have been working on EAD since 2008 onwards.

Now that my I-140 is approved, I was wondering if we can utilize the same I-485 now changing it to myself as primary and hers as derivative. I suspect those applications are already pre adjudicated.

My questions are
1. Is it possible to change derivative as primary as described above
2. If so what is the exact procedure. Thank you
