The university filed EB1B I140 and I485 concurrently.Later,I filed NIW.The EB1B got denied,and the university did appeal.However, I485 wasn't denied.I was told by USCIS that because NIW was pending,I485 wouldn’t be denied at that time.Afterwards,I filed another NIW at TSC(the previous 2 cases were filed in Nebraska).5 months ago, my first NIW I140 got approved,my attorney requested USCIS linking the pending I485 to my approved NIW I140.She did receive a letter stating the interlinking has been done successfully.However, today I received a denial letter saying the I485 must be denied due to the porting EB1B has been denied. Which one (to reopen or refile I485) is better? Can I extend my 8th year H1B depending on this situation? Do I need to withdraw other pending cases (TSC NIW & EB1B)?
