I am planning to switch employer from A to B. Currently on H1B with approved Labor & I140(EB2) with August 08 Priority Date(PD) from Employer A.
Questions:
1. If my August 2008 PD gets current while working for Employer B,can I file I-485 based on approved I-140 from Employer A in case it has not been revoked by Employer A and Employer B has not filed I-140 for me.
2. If Employer A revokes I-140, can I still port to older priority date (approved copy of I-140 available) when Employer B I-140 gets approved.
3. Due to recent anticipated movement in EB2 date for India, is there possibility of my Aug 2008 PD (EB2) getting current?
4. Employer B job requirement is 8+ years of related work experience and Bachelors (Masters preferred). Will Employer B be able to file under EB2.
