I-140 denied for lack of documentation to sustain advanced degre
I filed an Eb-2 NIW petition when I was under E-2 status (I-94 valid to July 20th, 2010). The petition was denied in Jan/2011. I sent a motion to re-open within the timeframe authorized by USCIS, with aditional information, Feb/20th/2011. In the decision letter from USCIS it is said that I have the right to appeal and that I may send a new petition with the proper documentation. I sent the motion to reopen the case but I still do not receive a recipt from USCIS regarding the motion to reopen... The problem is that I am not sure if now I am out of status (illegal?). I want to know if I can make a petition of extension of stay under E-2 status, now. Is it a good idea to file a new Eb-2 petition, with the evidence I could not send the first time, while the motion to reopen is pending?
