Convert from EB3 to EB2
My Labor was applied in Dec 2004 in EB-3 Category with my old employer.
My I-140 was approved in Jun 2007 and I applied for I-485 in Jul 2007.
I recently moved to a new company under AC 21 portability rule in EB 3 category. My current job and my old job are similar.
Can I now request my new employer to file for a EB-2 Category Green Card filing without any job change with new employer? If I need to apply for EB-2 category, do I have to change job title or responsibilities? Is it compulsory for me to get a promotion?
