Q.

Regarding I-140 portability

My wife is on H-1B and her I-140 has recently been approved. Her 6 year H-1 is expiring in Dec 2011 and her employer has not applied for 3 year extension yet. I am on H-1B status.

We are working in different locations in the country and my wife wants to join me by quitting the job and becoming H-4 dependent.

Assume that her employer does not revoke her I-140 and she successfully does a COS to H-4.

Now, in my location, after a while, if she finds another employer willing to sponsor her H-1B after she becomes H-4, will she be able to use her I-140 approval to get a 3 year H-1B?
