Original labor cert was lost in mail.I applied for I-140 on 16 Jul'10 & Notice date is 20 Jul’10 in regular processing at TSC as I'm not eligible for PP.My lawyer asked the USCIS to get the duplicate Labour copy from DOL.It has been more than 6 months & status says initial review.

1) Is it safe to open SR given that original labor cert is missing? total processing time for EB2 at TSC is 4.8 months.

2) I am on my 6th yr of H1B & it’ll expire on 30 Dec’11.Can I upgrade my I-140 to PP within 6 months of expiry of H1b?my labor cert was lost in mail and I'm not eligible for PP.

3)My EB2 dates are current, I was not able to apply for 485.Do you advise me to apply for I-485 before I get my approval of I-140.DOL website clearly says not to apply concurrent & wait until I-140 is approved.
