Q.

EB2 perm Labor Approved - Porting issue

I am trying to port my EB3 Priority Date, Country ,India (09/24/2003)to EB2.
Waiting to file my I 140 premium.I have a question on that.

I want to file my Wife's H4 visa.She is in US, right now , on a L1 Visa.

Do I have to wait till my wife's H4 Visa is approved and then apply for my EB2 I - 140,Premium and eventually I -485 for my wife ?

Will there be any issues with her legal status in the interim?
