Q.

Multiple I140 / 485

Comp A (future GC)had filed for ROW EB2 140 & 485 concurrenlty in July, got EAD in Oct. I am on H1, my wife is using EAD. We now have a I140 RFE. In mean while, my present Company B has filed EB2 Labor in Dec.

1. Can I have a RFE/ appeal on Comp A 140 & file a new 140 from company B ? The chances of Company A 140 getting rejected is high.
2. Is the EAD tied to a particular pending 485. Like if Company B file my I140 & 485 is the old EAD still valid, since i will have pending AOS ?
3. If Company A I140 RFE is rejected and we appeal, she can still work on that EAD. What is teh 140 appeal time? I want to buy time here.
4. Will the company A & B applications collide at some point in the process?
5. Could you give me the best advice, so my wife can keep the EAD active ?
