Q.

Working on EAD, I485 Pending, I-94 based on H1B expiring.

Case Details :
a) I-485 pending since July 2007
b) EB3 India, Priority Date of Oct 2006.
c) I-140 was approved in Oct 2007.

I am currently working on EAD. I switched from my previous (GC sponsoring) employer using AC21 , in May 2010. I sent AC21 documents but did not get a response from USCIS.

I was working on H1B for my previous company. The last time I entered US , I was on H1B and my I-94 (H1B based) expires on 5th Nov.

Is this a problem? Will I be considered out of status/illegal after 5th Nov.

What is my status after 5th Nov?

What is to be done? Will there be any problem when I enter US next time on AP?
