Q.

Emplyment Bases v Family Based GC

I filed for my I-140/I-485 concurrently in Aug. 2007, EB-3. My priority date is Aug. 1st, 2003.

I applied for my GC thru company A, i stayed with them till 2003, and then worked at compnay B till present on H1-B. In the meantime, my GC application was still on A. My H1-B and EAD expired on 10/08. I just renewed my EAD, lawyer said no need to renew H1-B. Today he informed that I need to go back to A! I don't want to do that, what are my options? Can I invoke an AC21?

On another note, my I-130 was approved in June 2005 (Unmarried son/daughter over 21yrs). My mom applied for me when she was a permenanent resident, and now she is a citizen. Can I apply for AOS through my I-130, how long will it take to get my GC if i follow that path?
