i 140 ability to pay
I receved an rfe on myi 140. I currently do not work for that company (future employment). USCIS is asking for 2009 tax returns.
Now my PD is May 2010. So instead of the 09 tax returns, can the employer submit quarterly tax statements for 2010 that'll show thier ability to pay my wage since May 2010?
I just don't understand why USCIS needs 2009 tax returns when my PD is in May 2010.
Also does USCIS tally up all the pending/outstanding I140s for the company to determine to ability to pay?
