Q.

I-485 EB2 - Eligibility Question, Primary applicant on H4 Visa

I have been in the US for last 8 yrs on H1b. My I-485 EB2(PD July 2006) was denied in June for Unauthorized employment. My current H1b is valid until July 2011. Came to India for VISA stamping and is in Administrative Processing 221g with no timeframe. My wife is in the US on H1b visa. I'm thinking of abandoning my H1b and apply for H4 VISA.Assuming I come to US on H4 VISA, I would like to know whether I'm still eligible to file I-485 based on my approved I-140 when the dates become current(And if I still have the job offer from my company).
