Q.

EB2 filing with current employer after rejoining

First to give some background:
I was working with companyA, they did my GC filing in EB3 with PD of Nov2003, I140 approved in Jan 2009, I485 pending since Aug 2007. My experience when I started with them was arnd 4 years and I dont have Masters, but now I have total of 8 years of experience (4 years at company A). They were not able to file my GC again in EB2 as any job change would have been similar to previous one.
I changed my job 3 months ago by doing H1 transfer assuming that they will file my GC in EB2 and port priority date, Now they dont seem much interested and want to wait longer.

Now my question is:
If I go back to employerA now in a similar position title as earlier, can they file my GC in EB2 now as My experience acquired out side of CompanyA is still less than 5 years?
