Q.

Second I-140, previous I-140 approved

I had my I-140 approved under EB-3 because wrong box was checked by mistake. The original labor that was filed was good for EB-2 (MS plus 3 years exp). I have MS and PhD.
Since it was approved in wrong category (because of mistake made by paralegal) in 2 days withPP processing,we did not get a chance to correct it before approval looking at the receipt notice and notifying USCIS before adjudication etc.Now that it is approved in EB-3, We have filed a second i-140 with new fee marking it as amendment by referncing the previous application receipt no. The orig labor was submitted with previous petition. We have attached photocopy with the new. The new receipt now shows EB-2 and other info is correct. Do you think we should get a new approval w/out any problem. Is it common?
