Q.

EB3 to EB2 for same employer

I'm sure you get this question a lot.

My labor was filed in EB3(India) with PD Mar 2005, I-140 approved, 485/AOS pending. I have a Masters degree and since graduating have worked with my current company for 6 years now. I have no hopes for any reform in this recessionary and xenophobic climate and realize that unless I do something, I'd be stuck in this situation for another 5 yrs.

I'd like to explore the option of filing for a new EB2 PERM with my existing employer given my MS+6yrs of exp. What are the factors involved here? Note that my experience is with the same company.

My EB3 was for a Software Engineer position. I am now a Senior Engineer.

What would you recommend I do? Anything other than waiting it out, please :)
