Q.

Applying for green card under EB2 (employer sponsor based)

Hi Indu,
My name is Jigar Bhajiwala and my question is:-
I have my I485 pending for approval under EB3 category. My employer filed under EB3 in 2005,eventhough I was eligible to apply under EB2(due to Master's degree before I joined the company). The HR is saying that there had been some miscommunication at the time of application which resulted in application under EB3. I want to persuade my Manager and HR to correct this mistake by reapplying under EB2,keeping my current priority date of EB3, what are my options? If you think we need to discuss this further on phone, I am willing to do that also. Please help.
