I received an approval yesterday for the PERM EB-2 category. Now the company lawyer is ready to file I-140. The company has still not filed the tax return for 2009 but has obtained an official extension till Sept. 2010 for filing the tax return. Furthermore, 2009 year has been a very bad busi. yr for us with the downturn in economy and according to accountant we may not have a satisfactory bus. performance for 2009. The comp. lawyer wants to use the 2008 tax return which is very good along with the 2009 tax filing extension copy for the I-140. Will this be fine for the I-140 filing. I just want a second opinion to avoid any issues. Thank you so much. Wick
