I have I-290 pending appeal for I 485 @AAO, EB2(I filed for appeal on 9/2008).and i applied on april /2010 for I 131 ,they sent me today deniel decision for I 131 stating that my I 485 denied on 8/2008 and therefore is no longer pending before USCIS, but they didnt mentioned anything about the pending appeal.
I have travel document approved on 6/2009 and approved EAD 3/2010 based on the I 290 pending appeal I 485.
I dont know why they deny it this time.
also stated i cant appeal on this decision.
1- do you advice to re-send another application with the examples of previous approved AP( after denied I 485 and pending appeal)
2- or send request to reconsider with explanation.
What do u adivce?
