As we spoke yesterday about my case,"previously approved I140 being revoked by USCIS after change of employer for not responding to RFE"
As I am exploring other possibilities now. To get on to legal status,
I can get my wife onto H1B and I can get back onto H4. Let say incase USCIS considers my I140 case and approves the 140 and then my case will be straight forward case. At the time adjudi of 485,Is it permssible under rules that I can be on H4 and wait for 485 adjusdicatioin.Since I am primary applicant of 485?(completed 10yrson H1)
1)Can I be on H4 legally till 485 adjudi? is I485 will be denied for this reason?
2)Other possiblity is to goto H4 for time being and comeback to H1 after I140 is approved.Do they consider my H4 period during I485 waiting period and deny my I485?
