Q.

Need advice on retention of green card

Myself and my wife have green cards since April 2005 and our daughter who is 9 years old has a US passport. I have been living in India since April 2008 having lived in the US for over 9 years. Our re-entry permits expire on July 28, 2010.

After spending a month in the US during May 2010, I am now back in India and have rejoined work. While in the US, I was late in applying for a second re-entry permit, and therefore the biometrics appointment came in after we had left the shores. We have requested for rescheduling the appointment to a later date.

Given the fact that my I-131 application is pending and I have also spent a month in the US, can I continue to be in India beyond July, 2010 without any adverse consequences to my green card? Please advise with action required on my end.
