Q.

MTR versus Appeal

Status :

1. EB 2 1-140 filed with 3 Yr ( B.com) + 2 YR PG ( MBA Finance) from India

2. Labor required PG ( or foreign equivalent) + 2 yrs exp or combination

3. Got a NOID that education is not equal to US PG

4. detailed edu eval. done proving crediential is US PG equivalent

5. still got the denial for same reason

6.in the 5th year of H1, 6th year due by 09/11

Qs-

a) What is the difference between an Appeal and an MTR

b) can I do both? if yes, what order?

c) Generally in these type of cases, what additional evidence/explanation is suitable/helpful?

d) Which option Appeal versus MTR is quicker?

e) Which options buys me the time that I can show it as a basis to extend H1 for additional one year after sep 2011
