Is our EAD re-instated while we are appealing?
I am on a L-1 visa (1st extension exp Aug 2011). I submitted my I-140 and I485. My I-140 was denied and subsequently, so was my I-485. When this was denied, my wife and my EAD were terminated. I have now filed a Motion to Reconsider and sent it to Texas. Does this mean that our EAD gets re-instated while the MTR is being considered? Our EAD were based on the I-140 and not on the L1/L2.
