Q.

Perm labour Denied : difference in job ad and perm application

my employer filled perm for me in may 08
filing date:5/16/08
Audit Date:8/18/08
Audit Reply:9/4/08
Denial Date:05/28/10
The reason for denial is perm application did not mention that travel is require while the job ad mentioned travel require. My job(software engineer) does not require travel. Attorney told me that they use generic job description ad which was accepted by DOL in the past and this is a government error. They are suggesting to file appeal as similar perm application for same employer in the same time frame was accepted.
1. What are chances of appeal getting accepted?
2. Is it a valid case to file appeal as govt error? does in past such appeal gets accepted?
3. how much time(any statistical data) will it take for appeal result?
4. what other option do i have?
