Q.

Applying for PERM-GC - 5th yr confusion

I got my first L1-B to US on Nov-2005 but my first entry to US on L1 was Mar-2006.I stayed here for 3 years 2 months , and after that 6 months was in India and came on H1-B visa during Dec 2009 , The H1 visa and the new I-94 was issued till Nov-2011 only(looks like USCIS have taken 6 years from Nov05 –including L1B but not sure ) , I am planning to start my GC before the end of 5th year as per law to continue my stay beyond 6 years .My question is : Do USCIS will consider my 5th year completion as Nov2010 ( that is 5 yrs from Nov-2005 based on my first L1 visa stamping to US) or 5th yr completion as Mar-2011 ( 5 yrs from Mar2006 based on my first actual entry on I-94 to US) for starting my GC process – Based on that , planning to switch employer if time is sufficient.
