Q.

Jobless, NIW EB2 I-140 approved 485 pending

NIW/EB2,I-140 approved Jan 2007 (filed by employer in Sep 2005), changed employer in Sep2006), I-485 pending since Sep 2005. From a retrogressed country. I have to quit my job for family reasons. I may not be able to find a new job atleast for 4-6 months. My question is do I have to have a job or job offer if my 485 is processed during this employment gap? I have read that NIW cases do not need to have a job offer? Will my status be legal during this period. My husband is employed on EAD based on my application. Also, in Feb 2010 I filed a new I-140 under EB1A (self petitioned, filed by a lawyer). If stay unemployed by choice, will it affect my GC process in a any negative way? Is it true that NIW and EB1A cases do not need to have employment offers?
