I-140 and layoff
I just got a 30 day layoff notice. Job ends June 17th. Labor is approved. But my company is still willing to file I-140 so I can keep priority date for future job with any other company.
Assuming it takes 2 months to get 140 approval, if I file now, my job will end 30 days into the 140 application process pending a decision.
I am thinking of having company attorney mail me the approval whenever they receive it which will be approximately 30 days after my job has ended.
My question is:
Is there a risk involved in applying for I-140 knowing job will end before decision is received from USCIS or should I just go ahead and apply for premium processing and get the approval before job ends.
Is it worth spending the extra $$ for premium processing.
