Q.

I-140 Denied

Perm approved-Nov 2007
I-140 applied-March 2007
I-140 Rfe April 2009
I-140 Denied recently
Reason: Company financial factors and also not capable to pay her employer but company is ready to fight as their attorney saying we can challenge their decision.They suggested me that either they can re-file i-140 or appeal the decision. they given us a option what to do?
My question: Can we re-file i-140 again with perm approved in year 2007.In my assumption we can only appeal the decision.

Please let me know what we can do in our case?
