Q.

Leave of Absence/Sabbatical for 1 Year

Background: I485 Pending since Jun 07 in EB3 India, Priority: June 2006, EAD & AP valid through Dec 2010, currently working for the sponsoring company on H1b.

I need to take a Leave of Absence/Sabbatical for a period of approx 1 Year for family reasons. I will be in the US for this entire period.

1. Will I still be considered "in” status during while I’m on leave?

2. Will this leave affect my I-485 application in any way? I do plan on resuming my work with the sponsoring employer after my leave.

3. What documents do I need from the letter (if any) to make sure I don't go out of status.

4. Can take up a part time/contract job during this year on my EAD to pay bills? Does this have to be in a same or similar position and does it need AC21 filing?
