Q.

Adjustment of Status (AOS) to Consular Processing (CP)

I’m planning to move back to India for some family reasons in 1st week of July. I'm working with US employer on H1B valid till Jul 17,2010 and never used EAD even I have one. I used AP last time and do have an approved AP renewal valid until Mar 10,2011.

After my move I like to continue the GC process as an option for the future and my employer would support this. My AOS I-485 is pending under EB3 with PD of 02/14/2005.

Based on the above mentioned scenario what would be the appropriate time line to file form I-824, requesting a CP? What is the procedure to file the I-824 to send my approved 140 to NVC? Does my employer need to be involved anything on this? Should I have to be here until the I-824 approved?

I have only around two months to do the proess now.
