Q.

perm audited and denied

Hi,
My perm application was filed on 03/06/2008 and was under an audit review since 06/16/2008, DOL denied my case due to an inconsistency in dates on the company's "Notice of Filing" document and the dates contained in the company's recruitment report submitted in response to the DOL audit. I'm already on my 6th year being on H1 B status. The Visa is currently valid until March 17 2011 ie., I have only about 11 months left on my H1B. Please suggest what would be my best course of action that would allow me to extend my H1B beyond 6 years. And also, can you clarify if my out of US days ( 78 days as of today ) can be reclaimed after my H1B visa expires on March 17 2011 since I have only 10 months to file for a new perm application.

Thanks !
