EB2 Labor Filing

Current Status
1. H1b since 2001 - 9 Years on H1b working
2. EB3 labor date July 2004
3. Plan to file EB2 labor from new employer for future employment
4. Total experience 14 years

Education
1. Associate Degree from India in 1995
2. BS (online in 2006 USA)
3. Education Evaluation does not evaluate me as MS based on education and experience

New Company lawyer says since I do not have MS, I will not be able to file in EB2 Category

How Could I file in EB2 category?
