NIW while out of the U.S.
I completed my Ph.D. in the U.S. and came to Canada for my postdoc last year. I filled I-140-NIW petition in this January. It was approved last week. I am from ROW and my visa number is current. I requested consular processing.
1. Can my sibling (currently a U.S. citizen) be a sponsor to fill I-864?
2. Do I need a U.S. job offer or actual job prior to the consular processing interview?
3. If I got a U.S. job offer before consular processing, can that U.S. employer file H1-B visa on behalf of myself?
4. Is their any cap limit for academic H1B?
5. If I accept J1 visa, will that be a problem for my green card?
6. Imagine I found a job in the U.S. If I move prior to the interview. Will a medical exam from a U.S. doctor be accepted during the consular processing?
