Q.

EB3 to EB2 porting

I have EB3 I485 pending with USCIS for more than 180 days. I am thinking of changing employers and take a position that is similar to what is on my LC but qualifies for EB2 (BS + 5 yrs exp). I have couple of questions

1. If I take the position with the new company using AC21, can I apply for EB2 petition for the same position or does the new employer have to create a brand new position and then apply for EB2 for that new position.

2. Can H1B transfer be used for AC21 or EAD is required for AC21.
