I140 denial as my education is not equivalent to US bachelors
Filed GC in EB3 as a Software Engineer for a skilled worker (E31) under Section 203(b)(3)(A)(ii) & on Mar'10 my I140 denied as Fed require a single degree that is a foreign equivalent degree, which is equivalent to the bachelors required in the labor & not a combination of degrees.USCIS erred in not considering the beneficiary for the lesser classification of E31.I have a 3 yr bachelors & 1yr PGDCA & 3 yrs MCA & also have education evaluation that equates them to a US degree.My employer advised to refile again from the PERM by loosing priority date through EB3 as a Computer support specialist - which doesnt require 4yr degree to get things done. How are the chances if I go through the same H1 company as performing different services? Shall I move to another H1 company & retry all again?
