Q.

EB 3 to EB 2

1. I have a Master degree in Mechanical Engg from a US university.
2. I have 6 yrs work experience in the same company.
3. I have an approved I 140 and I am waiting to file I 485 my PD is 09/2004.
4. I have already completed 6 yrs on H1B and I am on extension for 3 more years due to I-140.
5. My attorney had somehow put me in EB3 citing reasons that my Labor will be rejected, am I eligible for EB 2?
6. If yes is it advisable to refile in Eb-2 category or wait in the current category till the PD becomes current.
7. Will I have to start the process of Labor certification, I-140 all over again and generally how long does it take.
8. Will I able shift my job in my current position if I get an offer from another company who are willing do my H1B?
