Porting old PD of previous I140 and new I140
I came to US first time on June 1999 on H1B through company A. Company A applied GC labor for me with PD Jan 2001 in EB3 and it was approved. They applied I140 also which I was not aware. On April 2002 I left company A and joined company B. Company B applied GC labor for me with PD May 2006 in EB3 and it was approved. I140 was also approved through company B. On July 2007 fiasco, me and my wife applied I485, EAD and AP based on I140 approved by company B. On March 2009 I left company B and joined company C using EAD. Through FOIA request, I have found that there was a I140 approved through company A for me with PD Jan 2001 and I got a copy of that.
Can I port old PD of Jan 2001? I have asked a lawyer and he told me we need to file new I140 with a request to use old PD. Is this correct?
