Related to approved I-140 and leaving employer
My GC is in-progress with PERM and I-140 approved.
- what is the general practice related to I-140 if an employee is laid off or voluntarily quits the company. In both cases, if the employee left the company on good terms, does the company revoke the I-140 petition or doesn't do anything with it. I am talking about the general industry process. Does the employer legally obligated to do anything.
Can the employee use that approved I-140 to get 3 year H1 extensions?
- If I have approved PERM and I-140 with Company X and didn't file I-485 because the dates were not current and leave the company X to join Y, can the company X continue my GC process if they are willing to based on future employment and file for I-485 and EAD when the priority dates become current..?
